ALEJANDRA GUTTY TANGO COACHING® (“Tango Coaching®,” “the site,” “we,” or “us”) welcomes you to its website located at www.alejandragutty.com, subject to the following Terms of Use.

ALEJANDRA GUTTY TANGO COACHING® invites you to read these Terms of Use carefully, as they outline the terms and conditions applicable to your navigation of the site, in accordance with applicable regulations. As ALEJANDRA GUTTY TANGO COACHING® may modify these Terms of Use in the future, we recommend that you periodically review them to stay informed of any changes. These Terms of Use are entered into between you and ALEJANDRA GUTTY TANGO COACHING®. 2. ACCESS TO SERVICES AND ACCOUNT SECURITY

ALEJANDRA GUTTY TANGO COACHING® reserves the right to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. You agree that ALEJANDRA GUTTY TANGO COACHING® shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services. We will not be liable if, for any reason, all or part of the Services are unavailable at any time or for any period. Occasionally, we may restrict access to certain parts of the Services, or to all of the Services, for users, including registered users.

We reserve the right to disable any username, password, or other identifier, whether chosen by you or provided by us, at any time at our sole discretion for any reason or for no reason at all, including if, in our opinion, you have violated any provision of these Terms of Use.

The Services are accessible worldwide, but this does not mean that all Services or features are available in your country, or that user contributions (as defined below) available through the Services are permitted in your country. ALEJANDRA GUTTY TANGO COACHING® may block access to certain Services (or certain features or content of the Services) in certain countries. It is your responsibility to ensure that your use of the Services is permitted in the country in which you reside. The Services are not available in all languages.

REGISTRATION

To access the site or some of the Services offered, you may be required to provide certain registration details or other information. You agree to: (a) provide true, accurate, current, and complete information about yourself in the registration form, and (b) promptly maintain and update such information to keep it true, accurate, current, and complete. If you provide information that is false, inaccurate, outdated, or incomplete, or if ALEJANDRA GUTTY TANGO COACHING® has reasonable grounds to suspect that such information is false, inaccurate, outdated, or incomplete, ALEJANDRA GUTTY TANGO COACHING® has the right to suspend or terminate your account and deny any current or future use of the Services (or any part thereof).

You also acknowledge that your account is personal to you and agree not to provide any other person access to the Services or any part thereof using your username, password, or other security information. It is your responsibility to maintain the security of your login credentials, and you are solely responsible for all activities that occur through your account. You agree to notify us immediately of any unauthorized access or use of your username or password or any other breach of security. You also agree to ensure that you log out of your account at the end of each session. You should take special care when accessing your account from a public or shared computer so that others do not see or record your password or other personal information. ALEJANDRA GUTTY TANGO COACHING® will not be liable for any acts or omissions on your part, including any damages of any kind incurred as a result of such acts or omissions.

3. User conduct

USE OF THE SERVICE

The site and the Service are intended solely for your personal and non-commercial use. You agree not to display, distribute, license, perform, publish, reproduce, duplicate, copy, create derivative works, modify, sell, resell, exploit, transfer, or upload for commercial purposes any part of the Service, the use of the Service, or access to the Service.

PROHIBITED USES

You hereby agree not to use the Services for any purpose that is illegal or prohibited by these Terms of Use, or for any purpose not reasonably contemplated by ALEJANDRA GUTTY TANGO COACHING®. For example, without limitation, you agree not to use the Services:

  • To impersonate or attempt to impersonate ALEJANDRA GUTTY TANGO COACHING®, an employee, another user, or any other person or entity (including, without limitation, by using email addresses or screen names associated with any of the foregoing) or to misrepresent your affiliation with any person or entity.
  • To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Services, or that, as we determine, may harm ALEJANDRA GUTTY TANGO COACHING® or users of the Services, or expose them to liability.

Additionally, you agree not to:

  • Avoid any measures we may use to prevent or restrict access to the Services.
  • Use the Services in any manner that could disable, overload, damage, or impair the Services or interfere with any other party’s use of the Site, including their ability to engage in real-time activities through the Site.
  • Use any robot, spider, or other automatic device, process, or means to access the Services for any purpose, including monitoring or copying any material on the Services.
  • Use any manual process to monitor or copy any material from the Services, or for any purpose not expressly authorized in these Terms of Use, without our prior written consent.
  • Use any device, software, or routine that interferes with the proper functioning of the Services.
  • Introduce any viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any part of the Services, the server on which the Services are stored, any server, computer, or database connected to the Services, or any private accounts of other users.
  • Attack the Services via a denial-of-service attack or a distributed denial-of-service attack.
  • Attempt in any way to interfere with the proper functioning of the Services.

If ALEJANDRA GUTTY TANGO COACHING® suspects that there has been a violation of these Terms of Use (except regarding copyright infringement notices as described below), it will immediately proceed to block the suspected account and deny access to the Site.

4. Health Disclaimer

ALEJANDRA GUTTY TANGO COACHING® may provide information related to physical exercise, fitness, dance, and body movement, intended solely for personal use and informational purposes. Physical exercise, in all its forms and with or without the use of equipment such as blocks, straps, or any other equipment that may be suggested by an instructor from ALEJANDRA GUTTY TANGO COACHING®, is a strenuous physical activity, and you are encouraged and advised to seek the advice of a physician before beginning any physical exercise regimen, routine, or program or using any suggested equipment, as shown in any of the Service’s video clips. The information contained in our videos is not intended to be medical or professional health advice. ALEJANDRA GUTTY TANGO COACHING® is not a medical organization, and its instructors or staff cannot provide you with medical advice or diagnosis. The information contained in this document should not be used to treat, diagnose, or prevent any disease or medical condition without the advice of a qualified medical professional. It is not mandatory for you to perform all suggestions and comments related to the use of equipment, postures, movements, and instructions, and you undertake such actions at your discretion while viewing the videos. If you have been sedentary and are not accustomed to physical exercise, if you are pregnant, or if you have pre-existing health conditions, you should obtain medical clearance before starting any exercise program.

By using the Service, you declare that you understand that physical exercise involves strenuous physical movement and that such activity carries the risk of injury, whether physical or mental. You understand that it is your responsibility to judge your physical and mental capabilities for such activities. It is your responsibility to ensure that while participating in classes, courses, programs, and activities of ALEJANDRA GUTTY TANGO COACHING®, you will not exceed your limits while engaging in such activity, that you will practice in a safe environment, on a non-slip surface, free from sharp objects or objects that may fall on you, and that you will select the appropriate level of activity for your skills and abilities, as well as for any mental or physical condition and/or limitation you may have. You understand that, from time to time, instructors may suggest physical adjustments or the use of equipment, and it is your sole responsibility to determine whether such adjustment or suggested equipment is appropriate for your level of ability and physical and mental condition.

You expressly waive and release any claims you may have at any time against ALEJANDRA GUTTY TANGO COACHING®, or any person or entity involved with the Site, including, but not limited to, its directors, officers, instructors, independent contractors, employees, agents, contractors, affiliates, and representatives, for injuries of any kind, for any damage or loss caused or allegedly caused by or in connection with the use or reliance on any content, event, good, or service available at www.alejandragutty.com.

5. Monitoring and Enforcement; Termination.

ALEJANDRA GUTTY TANGO COACHING® has the right to:

  • Remove any user contribution or submission for any reason or for no reason at our sole discretion.
  • Take any action regarding any User Contribution that we deem necessary or appropriate at our sole discretion, including if we believe that such User Contribution violates the Terms of Use, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the Services or the public, or could create any liability for ALEJANDRA GUTTY TANGO COACHING®.
  • Disclose your identity or other information about you to any third party claiming that material posted by you violates their rights, including their intellectual property rights or their right to privacy.
  • Terminate or suspend your access to all or part of the Services for any reason or for no reason, including, but not limited to, (i) any violation of these Terms of Use, (ii) if you fail to pay any fee owed, (iii) if you submit or send fraudulent chargeback requests, or (iv) for any other reason at our reasonable sole discretion.

You agree that any termination of your access to the Service under any provision of these Terms of Use may be carried out without prior notice, and you acknowledge and agree that ALEJANDRA GUTTY TANGO COACHING® may deactivate or delete your account and all related information and files in your account and/or prohibit any further access to such files or the Service immediately. Furthermore, you agree that ALEJANDRA GUTTY TANGO COACHING® will not be liable to you or any third party for any termination of your access to the Service.

6. Reliance on Published Information

The information presented in or through the Services is made available solely for general informational purposes. We do not guarantee the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Services, or by anyone who may be informed of any of its contents.

The Services may include content provided by third parties, including materials provided by other users, bloggers, and third-party licensors, distributors, aggregators, and/or reporting services. 7. Fees

ALEJANDRA GUTTY TANGO COACHING® offers online courses and other services and products in exchange for a fee. You agree to pay the fees for the content you purchase and authorize ALEJANDRA GUTTY TANGO COACHING® to charge you for the services using the selected payment method. Fees will be charged regardless of whether you use the purchased services or not. You are responsible for paying all fees charged by ALEJANDRA GUTTY TANGO COACHING® and applicable taxes in a timely manner. We reserve the right to disable or remove access to any content for which we have not received proper payment.

Fees may vary based on your location and other factors. If you are logged into your account, the currency you see will be based on your location when you created your account. However, the final fees charged to you will always be calculated in U.S. dollars; therefore, the final fees charged may vary based on the prevailing exchange rates offered by our payment processors.

Occasionally, we run promotions and sales for our content, during which certain content is available at discounted prices for a limited time. The applicable price for the content will be the price at the time you complete your purchase of the content.

You agree that ALEJANDRA GUTTY TANGO COACHING® may update its payment methods using the information provided to us by our payment service providers and authorize us to continue charging the applicable fees at that time to your updated payment method.

ALEJANDRA GUTTY TANGO COACHING® reserves the right, at any time, to change any fees or to begin charging for any free service at its sole discretion. Any changes, updates, or modifications will take effect immediately upon posting through the relevant services (such changes will not apply to fees paid before the time of the change).

8. Payments, Refunds, Cancellation, and Termination

To purchase products from ALEJANDRA GUTTY TANGO COACHING®, a card or account enabled with one of the payment processors authorized by the Site (the “Payment Processors”) is required. Free accounts do not require card numbers or financial platform account numbers. When purchasing products, whether physical or digital, one-time payments are made.

The service is billed in advance and is non-refundable. To treat everyone equally, no exceptions will be made.

All fees exclude taxes, levies, or duties imposed by state authorities, and you will be responsible for paying all those taxes, levies, or duties if you use the service as a business. Additional amounts may be owed to individuals, such as VAT in your country of residence.

We use accredited third-party payment processors to bill you through a payment account linked to your ALEJANDRA GUTTY TANGO COACHING® account, and we do not have access to or store any of your payment data.

Payment processing will be subject to the terms, conditions, and privacy policies of the Payment Processors, in addition to this Agreement. Our current Payment Processors are MercadoPago and PayPal, and your payments are processed by them according to their terms of service and privacy policy. You agree to pay us, through the Payment Processors, all charges at the current prices for any purchase in accordance with the applicable payment terms. You agree to make payments using the payment method you provide with your Account. We reserve the right to correct or instruct our Payment Processors to correct any errors or mistakes, even if payment has already been requested or received.

If you permanently delete your ALEJANDRA GUTTY TANGO COACHING® account, you will lose all content that you have paid for or purchased. ALEJANDRA GUTTY TANGO COACHING® accepts no responsibility for such loss. This information cannot be recovered once your account is permanently deleted. If you wish to permanently delete your account, and not be able to reactivate it, please contact us through our customer service/chat/messaging software located in the bottom right corner of our website, with the request to permanently delete your ALEJANDRA GUTTY TANGO COACHING® account.

ALEJANDRA GUTTY TANGO COACHING®, at its sole discretion, has the right to suspend or cancel your account and deny any current or future use of the Service, or any other service of ALEJANDRA GUTTY TANGO COACHING®, for any reason and at any time. For example, we may suspend or cancel your use if you do not comply with these Terms or if you use the Service in any way that causes us legal liability or disrupts the use of the Service by others. Such cancellation of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the loss and waiver of all content in your Account.

REFUND POLICY

Please review the refund terms and thoroughly check our free materials before purchasing a product or subscription. Be sure to test the service thoroughly before purchase because WE DO NOT ISSUE REFUNDS once you make a payment.
We provide the service as-is. You use it at your own risk and discretion. This means that no warranty is offered, either express or implied. There is no implied warranty of merchantability, fitness for a particular purpose, availability, security, title, or non-infringement.
You may use our free services at no charge or choose to purchase a subscription (billed monthly or annually) or product.
If you have a subscription, it automatically renews unless you cancel it. We send you emails notifying you of each upcoming payment.
If you no longer need our service, please remember to cancel your subscription before the renewal date to avoid being charged for the next cycle. You can cancel your subscription in the following ways:
You can contact our support team with a request to cancel your subscription before the current billing cycle ends.
If you cancel the subscription before the renewal date, you will continue to have access to all premium features until the end of the original billing cycle. (Therefore, to use the subscription for only one month, you must cancel it during the current billing cycle (before the renewal date), even on the same day you placed an order).

WE DO NOT ISSUE REFUNDS once you purchase a subscription or product, whether physical or digital, including in the following cases:

I) You do not like the service/product.
II) You no longer need the service/product.
III) You are not satisfied with the features provided by our service or have not found certain specific features.
IV) You found another service/product that you like more.
V) You are not satisfied with the loading or playback speed of a file on your local device. Please note that loading and download speeds are beyond our control; they depend solely on your internet connection’s upload and download bandwidth or the upload and download capabilities of your Internet Service Provider (ISP).
VI) You experienced temporary technical issues while using our service. We do our best to resolve any problems or errors related to the service as soon as they are reported.
VII) You did not meet deadlines or suffered other damages or losses that may arise from using our service or its unavailability. You use the service at your own risk and discretion, and there is no warranty.
VIII) You forgot to cancel the subscription yourself or requested assistance from our support team to cancel the subscription before the renewal date. If you forgot to cancel your annual subscription, you can switch to a monthly subscription only within the month following the renewal.

9. Gift cards and discount coupons

ALEJANDRA GUTTY TANGO COACHING® or our partners may offer gift cards or discount coupons that can be used to purchase our eligible courses subject to the included terms. You must create or have an existing and valid ALEJANDRA GUTTY TANGO COACHING® account to redeem any of them.

Gift cards or discount coupons offered by ALEJANDRA GUTTY TANGO COACHING® are non-resellable and are not refundable or redeemable for cash or any cash equivalent, with no exceptions.

ALEJANDRA GUTTY TANGO COACHING® is not responsible for any lost or stolen gift cards or discount coupons or for their use without your permission. We may withdraw or cancel the card or coupon and require an alternative form of payment if we suspect that the gift card may have been stolen or used fraudulently. Gift cards or discount coupons are not valid and will not be accepted, and ALEJANDRA GUTTY TANGO COACHING® will not be liable if they are obtained from unauthorized sellers, distributors, or resellers.

10. Complete agreement

The Terms of Use constitute the sole and complete agreement between you and ALEJANDRA GUTTY TANGO COACHING® regarding the Services and replace all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.

11. Lenguage

Any version of these Terms in a language other than Spanish is provided for your convenience, and you understand and agree that the Spanish language version will prevail in any situation.
